Protecting victims of nursing home negligence

Just like hospital negligence, nursing home negligence is a serious concern for residents and their families. Patients seeking medical care are oftentimes in a vulnerable position and this can be especially true of nursing home patients and residents. Elderly, and sometimes disabled, individuals move into nursing homes and long-term care facilities entrusting their physical and mental health to these facilities and relying on the expectation that they will be well cared for. At times, however, negligent care can cause harm to victims.

In some circumstances, nursing home negligence and nursing home errors in treatment can take place because staff is not properly qualified or trained; the staffing is inadequate; residents are isolated; or the staff has a history of violence. There are a variety of potential legal consequences associated with improper care in the nursing home setting and one option is a legal claim for damages brought by the victim or family members of loved ones harmed in a nursing home.

Liability for damages associated with nursing home negligence can include circumstances of negligent personal supervision or care; negligent hiring or retention of staff; negligent maintenance of the nursing home facility; or negligence use of or maintenance of equipment. When a nursing home facility and its employees have breached a duty of care owed to the victim, they may be liable to compensate the victim for the damages they have suffered.

Victims of nursing home negligence can suffer physical, financial and emotional harm as a result of nursing home errors and the negligent care they receive. The personal injury and wrongful death legal claims processes provide protections, resources and remedies to help victims and hold negligent care providers accountable for the harm they have caused.
