Most lawsuits for "birth injuries" fall into two categories — trauma to the baby during delivery and lack of oxygen to the brain, often known as anoxia or asphyxia. Lack of oxygen can occur when blood flow is temporarily decreased due to a variety of events, including cord compression, prolapse, uterine rupture or separation of the placenta. If the attending physician fails to recognize and promptly address such an obstetrical emergency, fetal distress can result in permanent injuries, including cerebral palsy, mental retardation, and developmental delays. Injuries can also be the result of inadequate prenatal care, including the failure to diagnose pregnancy-related hypertension, also known as eclampsia, failure to properly monitor fetal growth, or failure to diagnose genetic or other abnormalities.
